The mouse patent was necessary for Canadian cancer research to go ahead. Harvard wouldn't have allowed any Canadian researchers to use the mouse without a Canadian patent to protect themselves. While I'm not usually a fan of patenting GMOs (Monsanto comes to mind), I think in this case, it's probably justified. Unfortunately, it opens the door for others to patent their creations as well....
